Welcome to the Bhazar Marketplace (the "Marketplace" or "Platform"), an online marketplace operated by BHAZAR S.R.L., a company registered in Romania (CUI: 53489103, Trade Registry: J2026005179006), with its registered office at Strada Traian 107, Sector 3, București, Romania.

The Bhazar Marketplace is a venue that connects independent third-party Sellers with Buyers. By accessing or using the Marketplace, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using the Marketplace.

Bhazar acts solely as an intermediary and technology provider. For every transaction:

• The contract of sale is concluded directly between the Buyer and the Seller who lists the product. Bhazar is not a party to that contract of sale.
• The Seller is the legal trader ("profesionist") responsible for the product, its description, conformity, conditions, warranties, invoicing, and the right of withdrawal under Romanian consumer law.
• Bhazar provides the Platform, the search and listing tools, the secure escrow checkout, payment facilitation, the dispute-mediation framework, and customer-support coordination.
• Where Bhazar itself lists and sells products as a first-party Seller, Bhazar assumes the Seller obligations for those specific listings.

This distinction does not reduce your statutory consumer rights, which always apply against the Seller as the legal trader.

• "Company" / "Platform" / "Bhazar" — BHAZAR S.R.L., operator of the Marketplace.
• "User" — Any person accessing or using the Marketplace.
• "Buyer" — A User who purchases or intends to purchase goods or services through the Marketplace.
• "Seller" — A third-party trader (professional or business) who lists and sells goods or services through the Marketplace.
• "Consumer" — A natural person acting outside their trade, business, or profession, as defined by OUG 34/2014.
• "Listing" — A product or service offer published by a Seller.
• "Escrow" — The mechanism by which Bhazar holds the Buyer's payment until the order and dispute conditions are satisfied, then releases funds to the Seller.
• "Payout" — The transfer of released escrow funds (net of fees) to the Seller.
• "Guilds" — The thematic divisions of the Bhazar ecosystem (Frith, Craft, Tech, Merchant, Omnism, Victualler).

• Buyers and Sellers must register an account to transact. You must provide accurate, current, and complete information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity under your account.
• Seller accounts require additional verification, including legal-entity identification, fiscal data, and a valid payout method.
• We may suspend or terminate accounts that violate these Terms, applicable law, or that present fraud or security risks.
• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to hold an account.

Sellers are independent traders and agree to:

• Act as the legal profesionist for their Listings and comply with all applicable Romanian and EU laws, including consumer-protection, fiscal, product-safety, and labelling requirements.
• Provide accurate, complete, non-misleading Listings: correct descriptions, images, prices (including VAT where applicable), stock, and delivery terms.
• Disclose, before purchase, all pre-contract information required by OUG 34/2014 Art. 6, including total price, delivery costs, complaint-handling policy, the legal conformity guarantee, any commercial warranty, and the conditions, deadline, and procedure for the right of withdrawal.
• Honour the statutory 14-day right of withdrawal and the legal conformity guarantee; a Seller may offer more generous terms but never less than the statutory minimum.
• Ship orders within the stated timeframe, issue valid fiscal invoices, and handle returns and refunds in accordance with the Refund & Return Policy.
• Only list goods and services they are legally entitled to sell, and never list any Prohibited Item (Section 11).
• Respond to Buyer messages and Bhazar dispute requests within the timeframes set by the Platform.

The Seller is solely liable to the Buyer for the products it sells, their conformity, and fulfilment of the sale contract.

Buyers agree to:

• Provide accurate order, delivery, and contact information.
• Pay the full order amount through the Marketplace's secure checkout. Payments must not be made outside the Platform; off-platform payments forfeit escrow and dispute protection.
• Use the Marketplace lawfully and not for fraudulent, abusive, or resale-circumvention purposes.
• Inspect delivered goods and raise any return, defect, or non-receipt claim through the Platform within the applicable windows.
• Communicate with Sellers and Bhazar in good faith during any dispute.

To protect both parties, payments are processed through escrow:

• When a Buyer pays, the funds are held by Bhazar's payment partner and are not immediately transferred to the Seller.
• Funds are released to the Seller after delivery is confirmed and the applicable dispute window has passed without an upheld claim.
• If a valid return, non-conformity, non-delivery, or dispute claim is raised within the window, funds may be refunded from escrow to the Buyer, in whole or in part, in accordance with the Refund & Return Policy.
• Escrow protection applies only to payments made through the Marketplace checkout.
• Specific dispute windows, including a short claim window for "item not received / empty parcel / not as described" events, are described in the Refund & Return Policy.

• Buyers pay the listed product price plus any delivery and applicable taxes shown at checkout. Bhazar does not charge Buyers a separate platform fee unless explicitly disclosed at checkout.
• Sellers pay a commission and/or transaction fee on completed sales, plus any optional service fees, as set out in the Seller Agreement and fee schedule. Fees are deducted from escrow before Payout.
• All fees are disclosed before they are incurred. We may change fees with prior notice; changes do not affect orders already placed.

• Released escrow funds are paid out to the Seller's verified payout method, net of fees, refunds, chargebacks, and any amounts withheld for open disputes.
• Payout timing and minimum thresholds are set out in the Seller Agreement.
• Bhazar may delay, withhold, or reverse a Payout where there is a pending dispute, a suspected breach of these Terms, fraud indicators, or a legal or regulatory requirement.

All prices are displayed in the applicable currency and include VAT where required by Romanian law. Sellers are responsible for the accuracy of their prices. Pricing or description errors will be corrected, and affected orders will be communicated to the Buyer; a Buyer may cancel an order affected by an obvious error before dispatch.

The following may not be listed, sold, or facilitated through the Marketplace:

• Illegal goods or services, stolen property, or counterfeit/infringing items.
• Weapons, ammunition, explosives, and regulated military or dual-use items where prohibited.
• Drugs, controlled substances, and related paraphernalia.
• Prescription medicines and unapproved medical devices.
• Live animals and protected species or products derived from them (CITES).
• Hazardous, recalled, or unsafe products.
• Adult content involving minors, or any content that is illegal under Romanian or EU law.
• Personal data, account credentials, or items that infringe privacy or intellectual-property rights.
• Any other goods or services restricted by law or by the Platform's published policies.

Prohibited conduct includes fraud, off-platform payment solicitation, fee circumvention, manipulation of reviews or ratings, unauthorized access, scraping, and any interference with the Platform's operation.

The Bhazar name, logo, guild emblems, Platform design, and software are the property of BHAZAR S.R.L. or its licensors and are protected by Romanian and international law. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

Sellers retain rights in their own Listing content but grant Bhazar a non-exclusive, worldwide licence to host, display, and promote that content for the operation and marketing of the Marketplace. Sellers warrant that their content does not infringe third-party rights.

Users may post reviews, ratings, and other content. Content must be accurate, lawful, and not defamatory, abusive, or misleading. We may moderate or remove content that violates these Terms. You grant Bhazar a licence to use submitted content in connection with the Marketplace.

To the maximum extent permitted by Romanian law, and without limiting the statutory rights a Consumer holds against the Seller:

• The Platform is provided "as is" without warranties of any kind regarding third-party Listings.
• Bhazar is not liable for the quality, safety, legality, or conformity of products sold by third-party Sellers, nor for the Seller's performance of the sale contract — these are the Seller's responsibility.
• Bhazar is not liable for indirect, incidental, special, or consequential damages.
• Where Bhazar acts as an intermediary, its total liability to a User for Platform services shall not exceed the fees Bhazar received in connection with the relevant transaction.

Nothing in this section excludes liability that cannot be excluded under Romanian law.

1. Buyer–Seller resolution: The Buyer first raises the issue with the Seller and/or submits a return or claim through the Platform. The Seller must respond within the Platform-defined window.
2. Platform mediation: If the parties do not reach agreement, either party may escalate to Bhazar. Bhazar reviews the order data, communications, and evidence (e.g., tracking, photos) and proposes a resolution. While a dispute is open, the relevant escrow funds are withheld.
3. Outcome: Bhazar may approve a full or partial refund from escrow, release funds to the Seller, or require a return. Decisions are based on these Terms, the Refund & Return Policy, and applicable law.
4. Consumer authorities: Nothing here limits a Consumer's right to contact ANPC or use alternative/online dispute resolution (Section 17).

Sellers agree to indemnify and hold Bhazar harmless from claims, losses, and liabilities arising from their Listings, products, breach of these Terms, or violation of law.

These Terms are governed by the laws of Romania. Disputes shall be submitted to the competent courts of Bucharest, Romania, without prejudice to any mandatory consumer-protection rules of the Consumer's country of residence.

We may update these Terms at any time. Changes will be posted on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance.
